Hausa“ Eugen)“ A VIEW FROM THE WOODS: NEW TREES ACT IS PROPOSED In late May, the MNR, in conjunction with the United Counties of Leeds and Grenville Agriculture and Reforestation Committee held three public meetings to introduce the proposed changes to the Trees Act, and to provide a forum for public comments. Those unable to attend the meeting may ï¬nd the following article of interest. The Tree Bylaws Advisory Committee has recommended that the current Trees Act (R.S.O. 1980, Chap. 510) be repealed, and replaced with a new Act. A new Trees Act would allow all municipalities to draft and pass local bylaws to cover the cutting, burning or other types of destruction of trees. Control held by counties, regions and districts (upper-tier municipalities) would be limited to woodlots one hectare (2.5 acres) and larger. At the same time, the new Act would give local municipalities the ability to pass bylaws to control tree cutting on lots less than one hectare, including windbreaks and single trees. IN PERTH Performances at Perth Collegiate Auditorium, Victoria Street Under the proposed new Act, municipalities would be able to draft bylaws to meet local needs. The new Act would also provide for an appeal process, and include tree protection orders that a municipality could use to protect significant or heritage trees. Municipalities could also require landowners to file a notice or obtain a permit before cutting. This application would provide information on the location of the cut, the size of the cut and who was conducting the work. This would give the municipality the information required to ensure that the cut was done properly, in accordance with good forestry practices. The new Act would also allow the municipality to issue a stop work order if any problems arise. Nursejcme goes to Hawaii The Tree Bylaws Advisory Committee recommends that all exemptions be removed from existing legislation so that municipalities have the power to include local exemptions. This would allow local municipalities to tailor bylaws to suit the needs of the community. The committee recommends that the term "good forestry practices" be defined in law. It also favours retaining the existing option that requires a landowner to rcplant improperly cut areas. The final recommendation is that the province (MNR) provide training for ofï¬cers who enforce tree cutting bylaws, assist municipalities in developing suitable bylaws, and introduce a public education program for community use.
