GREER The Ministry of Con- sumer and Commercial Relations have recently announced the estab- lishment of a new com- pensation fund for car buyers. The Motor Ve- hicle Dealers. Compen- sation Fund will be es- tablished in early 1984 and will lend an extra measure of protection for the car buyer who has been caught in a dealership bankruptcy or who has a legitimate unpaid claim against an automobile dealer. The Motor Vehicle Dealers Compensa- tion Fund will replace previous requirements dating back from 1965, where dealers posted a $5,000 bond in order to protect the consumer. The old requirement which has been deemed inadequate by inflation will remain in effect until the Motor Vehicle Dealers Compensation Fund is operational. The fund will be financed by industry through levies against motor vehicle dealers and will be con- trolled by a committee of dealers, government and appointed repre- sentatives. ; Once this fund is fully operational, car buyers who have made a down- payment on the pur- chase of an automobile from a registered deal- ership will be able to apply to the fund for compensation if the dealership is placed in receivership, goes into bankruptcy or fails to protect the buyer's deposit as required by legislation. As_ well those consumers who have unpaid judgments against a dealer for damages suffered as a result of a transac- tion involving a trade in a motor vehicle will be allowed to apply for compensation from the fund for the amount of the judgment. In short, the fund will increase protection for the consumer which re- ducing paper work and saving dealers money when compared to the cost of bonding.
