TinniTus soluTions wax reMoval on-siTe Hearing aid repair & Cleaning A convicted sex offender found guilty of an offence involving a child at a Whitby daycare centre has been sentenced to two years less a day in jail and will be subjected to ongoing monitoring, according to a recent judgment. Christopher Benson will serve one year for breaching the terms of a previous sentence that prohibited him from having contact with children, and a consecutive year-long term for making sexually explicit material available to a child. He'll be placed on the sex offender registry for life, and be subject to probation for three years following his jail time. In announcing the sentence, Ontario Court judge Brenda Green said she could have imposed a longer jail term in the case, but chose not to so as to be able to order the three-year term of probation. "To be clear, a longer custodial period is warranted for each offence," Green wrote in her decision. "I find, however, that in the unique facts of this case, there is a public interest in a lengthy period of community supervision with multiple terms once Mr. Benson is released from custody. " Benson, 42, was charged with several offences, including sexual assault, in 2019. Durham police alleged at the time Benson had committed the offences against a young girl who attended a home-based daycare centre run by his wife at their home in Whitby. At the time the charges were laid, Benson had already served time for sexual assaults involving multiple adolescent girls and women, and was subject to a 10-year order prohibiting him from attending places children might congregate, including daycare centres, Green noted. The order was effective until August of 2018 and, according to police, the offences were alleged to have occurred between February and June of that year. "These terms were intended to prevent (Benson) from having access to children or adolescents in order to protect them from him," Green said. At trial, Benson pleaded guilty to breaching the order that prevented him from having contact with minors, and not guilty to the allegations of sexual conduct with a child. He was acquitted of three charges involving sexual interference and other offences, but found guilty of making sexually explicit material available to a child. The daycare at which the incident occurred had been closed in 2012 after the Children's Aid Society became aware of Benson's presence in the home and his status as a sex offender, the ruling says. The court heard that the centre was "covertly" reopened that same year and operated until Benson's arrest in June of 2019. Benson, who was found guilty of showing the child pornography on his phone, took advantage of the girl, Green found. "He purposefully showed (the child) this sexually explicit material as the next step in the process of grooming her for future sexual offences," the judge commented, calling Benson "a manipulative, depraved adult." "This was a premeditated, opportunistic, predatory offence of a helpless little girl and Mr. Benson preyed on her vulnerabilities," the judge said. MAN SENTENCED TO JAIL FOR 'DEPRAVED' CRIME AGAINST CHILD A man has been jailed for an offence committed against a young child at a Whitby daycare centre. The female victim came forward in February 2022 to report an alleged sexual assault by an employee of the Rotherglen Centre in Pickering in 1984. The victim, who was 15 years old, alleges the assault happened at the youth detention centre. Shyleem Khan, 77, of Wellington County, Ont., is facing two counts of sexual assault and two counts of gross indecency. Police want to ensure there are no further victims.
