DURHAMREGION.COM/COMMUNITYDIVERSITY A Durham judge has imposed a 12- month sentence of house arrest on a repeat child pornography offender, citing the man's commitment to counselling and the low risk he presents to the community. While an in-custody jail term is commonly imposed in such cases, a community sentence is sufficient to denounce Biagio Trentadue's conduct and prevent further offences, Ontario Court judge Peter West said in a recently released decision. Trentadue, who was previously convicted of possessing child pornography in 2013, will serve the entirety of his sentence under house arrest and will be electronically monitored during that time, West ruled. He'll be on probation for three years following that. "In my view this is one of those extremely rare cases where a sentence other than 'real' jail, one served in the community, can adequately respond to all of the relevant objectives of sentencing, including denunciation and general deterrence," the judge said in his decision. "It is my view the house arrest condition with electronic supervision adequately addresses the principles of denunciation and deterrence." Court heard that police began an investigation into Trentadue in February of 2020 after receiving information about a computer user uploading a pornographic image. Police identified the user's email address as being registered with the Sex Offender Registry, according to a statement of facts. Trentadue was arrested in June of 2020 and charged with accessing child pornography. He pleaded guilty a year later. During a sentencing hearing the Crown pressed for a jail sentence of four months' jail time, followed by three years of probation. Defence lawyer Sandip Khehra argued for a 12-month term of house arrest, with electronic monitoring. In considering an appropriate sentence, the judge assessed Trentadue's efforts to obtain treatment for what he describes as an addiction to pornography. "It is apparent ... that Mr. Trentadue is very committed to doing everything in his power to prevent a relapse," West commented. "Mr. Trentadue is an excellent candidate to be involved in community supervision." Trentadue admitted to accessing illegal material, but "the factual background demonstrates that Mr. Trentadue is not involved in the distribution or production of child pornography," the judge found. In addition, the 2020 police investigation resulted in no seizure of illegal images or videos. "There was no collection of images or videos. Rather, the facts were that Mr. Trentadue uploaded one image of child pornography and when his devices were seized by warrant and searched no child pornography images or videos were discovered," West said. "There also was no evidence that Mr. Trentadue ever harmed a child or purchased child pornography." Trentadue, 49 when he was sentenced in January, was convicted of possessing child pornography and sentenced to 30 days in jail in 2013. That conviction came about after Trentadue, in custody on an unrelated charge, confessed to Durham police that he'd been viewing child porn.
