* PAGE 2, WEDNESDAY. APRIL 16. 1980. WHITBY FREE PRESS * CLOC4 can't or won't do anything..,. T ree Whitb fa illies stranded By MICHAEL KNELL Free Press Staff Tbree Whitby familles are effectively stranded in their home own. Titey might as welI be a desert island and iL doesn'tl ook like thte respon- sible level of government can or will come to their aid. The titree families live in a secluded area soutli 0f the Lynde Shores Conservation Area on the shores of Lake Ontario. During the severe storm that struck most of southern Ontario hree weeks ago, the bridge that links their homes to te rest of town was washed out, effectively stranding hem unless they walk about a mile along the leach to the nearest con- cession road. And it doe not appear as though the Central Lake On- tario Conservation Authority (CLOCA) will corne to their aid. Fred Brooks, one of the residents, said titat the authority was approached asking for aid to reconstruct the bridge but was turned down. Brooks, a working musician, said that since the storm ite has been unable to return to bis home to get his equlpment out and he is Iosing a sizeable portion of bis income. Since the storm, Brooks bas been living with bis mother in the West Lyntde subdivision. He said tbat CLOCA will flot give any belp to the residents. "They've washed their liands of thte whole tbing," Brooks said adding, "IL seems like hands off situation." If their appeal'to CLOCA ànd otiter levels of gover- nment doesn'L suceed Brooks said that "1we may have to build (a bridge) our- selves." However, lie pointed out tat if hey did that, the residents would be liable for anyone having an accident on thte bridge. "I's kind of a sticky situation that way too," he said. Under thte present arrangement with CLOCA, the residents are responsible for maintaining thte access road to their homes and for te bridge, Brooks said, ad- ding that the residents have no argument with this. Margaret Mann, another 4 125 47)THE THE of the residents, told the Free Press titat when her husband, John, appeared before CLOCA he was told by chairman John Goodwin tat the "vehicle access was not necessary. " Mann said that ber's and another family bave small children and while their is no immediate danger Lo tbem, many emergency services cannot reach thLem if there was ever a need. She also said that one of Whitby's representatives Lo CLOCA, East Ward Cowi- cillor Joe Drumm had asked for 'the rnatter Lo be brought up again at the next meeting wbicli is scbeduled for next Monday. However, this dmoesnt ap- pear to have given the resid- ends any comfort as Mann said that "we can't do anything until the 22nd" (the meeting date). The mother of Lhree echoed Brooks' concern that there 'would be a "liability problem if we rebuild the bridge." The most immediate danger that the residents face is the possibility of fire as Mann said that she received a registered letter on April 8 from Fire Chef Ed Croucit stating that there is "no fire protection without a bridge." "Unless they corne down by boat" titere is no way they can reacit us, " she said. During an interview Lo get their side of te story, CLOCA manager Bill Cam- pbell said that, "tite autbority told the residents in June, 1978 tàt they would assume no responsbility for te bridge or te roadway." / "The residents have a right of way tbrougb landIs and tbey are allowed to maintain the road, " he said. 5TH ANNIVERSARY 1855-1980qè CORPORATION 0F TOWN 0F WITBY NOTICE 0F APPLICATION TO THE ONTARIO MUNICIPAL BOARD 5V THE CORPORATION 0F THE TOWN 0F WHITBY FOR AN ORDER TO AUTHORIZE A BUS FRANCHISE AGREEMENT TAKE NOTICE THAT the Corporation af the Tawn of WhItby fias epplied ta the Ontario Municipal Board pursuanita ifthe provisians af Section 354 <1), Paragraph 89 ai The Municipal Act and Section 6, Subsection id ai The Municipal Franchises Act for an ardor ta autharize an agreement wth Charter. ways Lbmited and ta grant a frachise upan the highways of the Tawn ai Wflltby for a municipal transit systom faor a period nat exceeding three years cammen- cing an the firei day ai June, 1980. Lin 2M8 Campbell said that CLOCA bas bent over back- wards to accommodate the residents even to te point of banning their own vehicles from te road and building a gate preventing its use to anyone but te residents. Tbey have even minimized public access to that road, he said. "We don't have any obligation to them," he said adding that te bridge was there long before the authority bought te land a few years ago. "We allowed te people the riglit of access only," Campbell said. "They shouid have been aware of that. " Will CLOCA undertake to rebuild the bridge? Cam- pbell says n0. "The authority is not in- terested in works there," lie said. IlWe are not retailiflg the road for use by anyone else." "It is a condition that has always existed there. " It would appear as the residents will have to wait until CLOCA's next meeting on Monday and tliey are probably praying that nothing goes wrong before then. >~j Brooks stands where the bridge once was Em Plyah Chaptur of Hdaaa.h -Wizo Adl Auction of original Canadien worka of art In ail media an Sunday, April 20, 1980 et the Pault Ovia Galery McLaughiln Sqijsro Oshawa, Ontaria Previ»w -8 .6 ..ta 8 P.m.
