Residients say By MICHAEL KNELL Free Press Staff According ta one area resident, the K-Mart Plaza at the corner of Kendalwood Road and Dundas Street, has always been a cause for cancerri. In a deputation ta council, W.A. Loveiock, of 121 Ken- dalwood Road, said that "the K-Mart Plaza has always caused minor probiems. " Lovelock said that the probiems centered around garbage and noise. Loveiock appeared before jcouncil at their iast regular meeting ta protest the location of the restaurant in the plans for an expanded plaza. Council gave approval ta the plan recentiy. The Corridor resident wanted council ta secure guarantees that the developer and the restaurant operators would not be the cause of future probiems. Loveiock wanted the council to regulate the hours of business of the restaurant and ta have piaced further west from its present site. Lovelock suggested that the restaurant be located in the north-west corner of the plaza but was toid by ad- ministrative committee chairman, Centre Ward Councillor Barry Evans, that this was unacceptable ta Dominion Stores Ltd. because it was used as a parking area by their customers. Lovelock responded by saying that local residents have neyer noticed that the area in question was that heavily used by anyone shopping at either Dominion or K-Mart. Council was told that the residents were concerned about odors coniing from the restaurant which would up- set the environment because the prevailing winds corne from the north-west. Lovelock said that while council may have the authority ta implement the residents' concerns into an agreement, they were worried about if guarantees could be secured should the proposed establishment change hands ulaza "If the restaurant were to change hands, what control could be had" ta control odor and garbage? Lovelock asked. "We are not opposed ta development," he said ad- ding, "But we do flot feel these questions have been answered properly at the administrative level. " Evans responded ta Lovelock's statement by assuing council that al alternative sites for the restaurant had been con- sidered, and that ail of the resident's concerns had been answered. "lIt was that (location) or nothing at ail," Evans said. "lIt is also not councii's business to regulate a business' hours, " he said. Evans said that another reason for not imposing such regulations is that the restaurant wili not be of a fast-food, take-out nature. Loveiock said, "I can't see how it (re-locating the restaurant to the north-west corner of the plaza) wili in- terfere with Dominion causes problems Store's parking." Planning director Bob Short said that in its present location the distance from the restaurant ta the nearest hause is 180 feet and that this " àmeets the set back requirements af the (plan- ning) byiaw." Short said that the praper- ty will not need an official Of plan or site plan amendiment but will require re-zoning. Regionai Councillor Bob Attersley said that the residents were not com- plaîning about the overal plan, just the restaurant and that the committee should take another look at the site.
