WHITBY FREE PRESS, WEDNESDAY, MAY 24,1989, PAGE 13 Two have differing« views onban at FamilyKartways By Debbie Luchuk The two sides involved in an assault at Family Kartways in Whitby have different views of a ban on use of Kartways, imposed on two family members as a result of the court judgment of the case. Family Kartways. banned Marilyn Thrasher and son Kevin from the property after Glen Butler, a Kartways employee, received an eight-month peace bond and was ordered not to go near the Thrashers. Marilyn Thrasher claims. the ban is on use of all Kartways activities, and that her whole family has been banned. But Glen Butler's father, Ron, wbo operates the private go-kart club track at Kartways, says tbe Thrasher family, apart from Marilyn and Kevin, can use the public go-kart or kiddies'uattrac- tions. Marilyn Thrasher says police investigating the incident could not do anything more to get the Thrashers on to Kartways' pro- .perty., pSe hsays that in March, 1988, Kevin bought a go-kart at Butler KartoServices, go-kart repair ser- vice on site at Kartways. "My son races there. He wan- ted the motor superstocked (made morempowerful), and when we got the motor turned it on, the motor seized, and Butler refused to repair it." She says the kart motor was fixed by George Con quer of Scar- borough, the only other repairer in the area. "To get it repaired, it cost a lot of money again and we tried to see if we could get our money back for the work done by But- ler," says Marilyn Thrasher. She says that when Kevin returned to the track to drive his kart, Ron and Glen Butler ripped pieces off the motor. "Kevin started yelling, and Glen Butler assaulted him. Glen Butler is about 25 years old and big, and my son is 16 and has a small stature," she says. The Crown laid a charge of assault against Glen Butler when the Thrashers reported the assault. The case came up in March of this year, and Thrasher says that she and Kevin were subpoenaed as witnesses. Glen Butler received an eight- month peace bond, and was ordered not to come within the vicinity of Kevin or Marilyn Thrasher. Later the Thrashers received two letters from Famil Kart- ways owner Dick Clark. ecause of the Crown judgment, Kevin and. his mother were banned from the Kartways'property. Marilyn Thrasher says she doesn't really care if she or her son are banned. "My son does not want to go back, and is selling his go-kart. I don't want to see this guy again, and I don't want any more trou- ble. "But my small children liked to go to the kiddie rides, and I don't see why we can't go up there." When contacted by The Free Press investigating officers for Durham Regional Police said there was nothing more they could do. Ron Butler has a different sto to tell about the events leadinup to the ban. "I sold a kart to Kevin, and he was happy with it. For the court case, "We roun- ded up 17 witnesses, and they did not even have one at the trial. The judge threw it out of court, and posted a peace bond for my son for eight months." Ron Butler says the banning of Kevin and Marilyn Thrasher is only to honor the rules of Glen's peace bond. "It strictly applies to the mother and son, because of the peace bond," he says, adding that if Mr. Thrasher or his other children wanted to use the Kart- way's kiddie attraction or the public go-kart, they were per- fectly entitled. Butler says there were a few Major scholarships are awarded at festival Two Whitby residents won major scholarships and Whitby public schools earned gold awards at the recent Kiwanis Music Festival. "We don't want the boy around here,» Butler says. "He brought the motor back, and I put the motor in his father's hand and said, quite clearly, "There is no oil in this motor," and I gave him a quart of oil to put in it before he started it. "Obviously, he took it home and started it and it seizedT up. He didn't even phone me, and went to one of my competitors," Ron Butler says. He adds that the Thrashers stopped their $300 payment on the motor restocking. The next day Kevin Thrasher went to the Butler shop, and Butler asked him to stay off the property until he paid his bill. Ron Butler says . Kevin Thrasher pushed Ron's wife and Glen's girlfriend, trashed the pro shop , "and used every four-letter word in the book. "Glen put him on the floor to settle him down," Ron Butler says, adding that Glen did not in any other way touch Kevin Thrasher. Later that night, an officer came and took a statement from Glen Butler, and from witnesses.
