NOTICE OF HEARING THE ONTARIO AUTOMOBILE INSURANCE BOARD (the "Board"), at the request of the Lieutenant Governor in Council, will hold a Hearing pursuantto section 28 of theOntario Automo- bile Insurance Board Act, 1988, S.O. 1988, c.18. Purpose of the Hearing The Lieutenant Governor in Council has ordered the Board to conduct public hearings to examine the threshold no fault sys- tem of privately delivered automobile insurance (vvith two speci- fied thresholds), and the choice no fault systern of privately delivered automobile insurance. The Order in Council dated March 2, 1989 (the "Reference"), containing the details of the systems under consideration, is available upon request. The Lieutenant Governor in Council has specifically ordered the Board to report on the following: 1. An estimation of the average prices that would becharged for automobile insurance policies within the referred systems, based on the mandatory classification systern, the determi- nations of fact and rates established by the Ontario Automo- bile Insurance Board under its decision of February 13,1989; 2. The feasibility of extending the systems to public-and commer- cial vehicles; 3. The cost impact, if any, of the implementation of an alterna- tive dispute resolution involving mediation and, if necessary, binding arbitration, for the settlement of no-fault compensation; 4. The administrative barriers that exist in relation to the systems that could result in significant additional costs either in im- plementation or in the continuing operation of the systems; 5. Whether there would be greater stability in theaverage prices charged for automobile insurance policies after implementa- tion of the systems; and 6. An estimation of the level of recovery to injured persons that would be achieved under the systems. The Board is to commence public hearings and report back to the Lieutenant Governor in Council as soon as is practicable. The Hearing THE HEARING will be held under File No. R-89-1 and will com- mence on Wednesday, April 12, 1989 at 9 o'clock a.rn. in the Board's Hearing Room, 2nd Floor, 5 Park Home Avenue, North York. A PRE-HEARING CONFERENCE will be held on Tuesday, March 21, 1989 at 2:30 p.m. in the Board's Hearing Room to deal with preliminary matters, including, but not limited to the following: • written evidence to be pre-filed • the interrogatory process • the hearing process • issues The Board has engaged a consultant to assist the Board. The consultant will price the two systems of privately delivered automobile insurance as set out in the Reference. This evidence will be pre-filed on or before Monday, April 3,1989. A SECOND PRE-HEARING CONFERENCE willbe held on Friday, April 7,1989 at 9:00 a.m. in the Board's Hearing Room to settle the issues and to deal with any other proced ural matters. "Sometimes it is a bit confus- in& to decision-makers as to why it is unsafe. I'm not convinced it (the intersection) is dangerous and unsafe because of the way you use words," said Wilkes. On Monday, Bill Irwin, the Town's lawyer had called Wayne Hancock,the Town's manager of engineering, to the stand. Hancock testified that he had requested the intersection im- provements, as part of his report to council. (Planning staff had approved the gas bar on condition that the intersection improvements were carried out.) "Our concern was that left hand turn movements would aggravate the situation . t the intersection. There shoul be a median to prohibit turns " said Hancock. "Your comments were pre- pared without any traffic ýxpert- ise, or is this a perception of a council of perfection?" asked Lord. Hancock replied that the Town does not hire traffic engineers. "We would ask the developer to do a review and then we would comment on that," said Hancock. Southland had hired Gough, from Marshall, Macklin, Monag- han, who testified earlier he saw no adverse affects from the gas bar. Hancock said he disagreed with that recommendation. "You were in a conflict of interset then," said Wilkes. "When you are making this powerful recommendation, aren't you saving this municipality a potful of money?" asked Wilkes. "It was never the council's intent to hook the developer for the cost of the intersection," replied Hancock. Lord then followed up on the q uestioning, noting that the own's official plan does not.con- tain a policy to make developers aware that they would have to contribute money for a rezoning. Robert Dragicevic, a planning consultant hired by the num- bered company, testified that the site is zoned C2 - highway com- mercial, which would allow a restaurant, hotel or motel and an automobile service station use that would not reqire dispensing gas. "Those C2 sites create more traffic and are destination orien- ted," said Dragicevic. He said the station would be operated by the numbered com- pany using the Shell Canada logo andproducts. It would have four islands plus a kiosk and canopy. "This is one of the least inten- sive uses that could be put on the property,"he said. The hearing was expected fin- ish either late Tuesday, after The Free Press deadline Wednes- day morning.
