Whitby administrative com- mnittee has recommended approv- ai of a "tourist activity node" designation for Cullen Gardens' "Prettiest Street in Ontario" expansion. Town planning director Bob Short said Monday night that the land use designation would restrict Su.nday shopping at the location unless Durham Region passed a bylaw to allow establish- ments to open Sunday. Committee members -had previously -expressed concernis about Sunday shopping at the "!Prettiest Street,". to comprise about 25 refurbished historic dwellings converted' to retail artisan craft and gift shops on the ground floor and bed and break- fast units on the upper floors. Planning department noted that retail and service commer- cial uses on holidays, including Sundays, within. the Prettiest Street are under the control of the Province. through. the Ratail Business Holidays -Act, and thal there are exceptions from the "n< shopping" rule on Sunday. The department aiso noted that aIl existrnig commercial anc tourist operations north Of Taunton Rd. at Cullen Gardens, ~uincluding the craft and gift shops, are permitted to be open on Sunday. The opening of Prettiest Little Street shops would be govemned under a section of the Retail Business Holidays Act that states conditions (maximum floorspace, number of employees) under which small stores cari rernain open and sel food stuifs, newspapers, tobacco articles, antiques or handicrafts. Another section of the Act allows a municipality, in this case Durham Region, to exempt a retail business from shopping restrictions, notes Whitby's plan- ning department. In another example under that section, a Metro Toronto bylaw allows Harborfront area retail stores to. operate on Sundays.
