0MB reyvises ,seève rance The Ontario Municipal. Board recently overturned a 'land division comnittee décision on a property in Whitby, by granting a severance of two instead of tbree lots. Oommittee had given approval last Novemnber, to Frank Giacalone's application to sever into threelots the property at'the soutbeast 'corner of King and Burns streets.. Giacalone originally wanted to build three duplexes, one on eacb. lot, but later revised bis plan- to two duplexes, to occupy two of the three lots. There is now a small bouse now on'the, property. Nearby residents, opposed to the duplexes whicb they said would be "incompatible" witb the surrounding neighborhood, later decided' to appeal the land division committe decision. 0MB member J. R. Milis, presidipng over the. appeal in Whitby Marcb 10, found in favor of the residents and gave consent to a severance of two lots instead of the three which he said would create a density that was "out of keeping with the neighborhood." The application had been complicated by an oversight regarding the zoning of the property as well as by the Burns- St. reconstruction which, with curbing, closed off the existingý access to the property. However, Milîs bad indicated that his decision on the appeal would only involve the subdivision of the property. John Davis of 825 King St. S., who represented the neighboing residents, said the' duplexes represented "inaxinium-size buil- dings on minimum-size lots." The three severed lots would eacb have a deptb of 95 or 100 feet and widtbs of 50, 55 and 60 feet, comparedto the 60-ft. by 120-ft. sizes of' nearby properties. Each of the two duplexes would be 1,700 sq. ft. in size. "We just have two massive buildings with no greenery at al in'front of them, or very little," said Davis, wbo said the duplexes would be twô stories higher' than the single family homes around them. "We wouldn't worry if there was only one duplex," Davis said, in testimony before the board. He added, in respon se to questions by the applicant's lawyer, Murray Miskin, that he would not object to more than one story "providing there was air around it." Davis - also said that the exýstng sm all . bouse on the property is a '"junkyard." Giacalone said the two duplexes, which he wants to give to bis son and daugbter, "will look very sharp, very nice, compared to the house existing on the whole block there." H1e claimed that--the buildings would alsoô increase the value of nearby homes, would not interfere with the privacy of nearby. home- owners and would have no effect on traffic as they would face King St., each witb a driveway and six parking spaces. Giacalone said that although curbing on Burns St. bad closed access to what would have been the third lot, he had been told that access would be permitted if a new bouse was erected on the lot. Davis mai ntained that the land division committee, when it gaveý consent to the ' three-lot severance, stated there would be no access to Burns, only to King. The objectirig residents also had discovered a planning oversght, pointing out that a 12-ft. section of the property was designated R2. Whitby planning department had previously offered no objection to the severance application as the entire property was believed to have been designated R3, which permits duplexes. R2 zoning does not permit duplexes. At a December meeting of the Town's administrative committee, councillors Ross Batten and Joe Drumm had advised the objecting residents not to appeal the severance decision at the 0MB.
