Forestaîl also told the committee that winter is not a good time to move the vehicle since it has been put on blocks and that ploughing lias piled snow around it. "If the chip truck is moved 10 feet from the roadway it will be allowed to stay until Mardi 31," West Ward Councillor Joe Bugelli, committee chairman, told Forestaîl. "What's he's trying to do is commen- dable, but you can't bend and break bylaws." According to town clerk Don McKay, the vehicle is in contravention of both the traffic and licencing bylaws. McKay said that the fish and chip stand is con- travenîng the traffic bylaw because a vending vehicle cannot remain on the un- travelled section of a town road al!owance for more than 10 minutes. The stand is also con- travening the licencing bylaw with respect to refreshment vehicles because it provides that refreshment vehicles will only lie allowed on road allowances adjoining com- mercial property. The Forestaîl vehicle is presently sitting next to residentiai land. IF the town went to court on the matter, McKay said that the Forestail face a fine of up to $1,000 plus costs for contravening the licencing bylaw. If convicted for commit- ting an offense under the traffic bylaw they could be fined anywhere between $5 to $10 for the first offense and $25 for eagh subsequent offense. The Forestall's licence to operate a refreshment vehicle expires at the end of March and'McKay said "we have the authority to refuse 11I think that in this case I would want to get legal ad- vise before doing so," he continued. If the Forestalîs did not comply with thje operations committee 's request, MacKay indicated that the license could be withheld. However, if they found property to locate on and received the approval of the medical off icer of health and other requirements to operate their vehicle the Forestail could flot be denied a license. However, in that case it would "no longer be a mobile fish and chip operation but a permanent, structure." MacKay stressed that before taking any action the town would make its decisiujn having regard with the position of the Forestalls.
