THE CORPORATION OF THE TOWN OF WHITBY THE EXPROPRIATIONS ACT NOTICE 0F APPLICATION FOR APPROVAL TO EXPROPRIATE LAND IN THE MATTER OF an application by The Corporation of the Town of Whitby, for approyal to expropriate land being an easement over Parts 34 and 35, Concession One, and the road allowance between the said Lots 34 and 35 in the Town of Whitby, in the Regional Municipality 'of Durham, for the purpose of constructing outfall sewers for the streets in the Almond Subdivision, namely, Cresser Avenue, Churchill Avenue and Almond Avenue. NOTICE IS HEREBY GIVEN that application has been made for approval to expropriate the land described as follows: A free and uninterrupted right of way of an easement in favour of the Corporation of the Town of Whitby, its successors and assigns, to construct, operate and maintain a storm sewer system in, under, across and upon ail those portions of Lots-34 and 35 in the First Concession of the Town of Whitby, in the Regional Municipality of Durham, formerly the Township of Whitby in the County of Ontario, and ail those portions of the road allowance between the said Lots 34 and 35, designated as Parts 1, 2, 3, 4, 5 and 6 on a Reference Plan deposited in the Registry Office for the Registry Division of Durham (No. 40) as Plan Number 40R-5044; such storm sewer system to include, without limiting the generality of the foregoing, ail pipes, mains, conduits, connec- tions, manholes, ditches and fixtures necessary or incidental thereto; Together wîth the right of the said Corporation of the Town of Whitby, its successors and assigns, through its and their servants, agents, employees and workmen, together will ail necessary tools and equipment, to enter upon the said lands at ail times and from time to time and to pass and repass thereon for the purpose of constructing, examining, repairing, renewing and maintaining the said storm sewer system or any part thereof, whether or not such part be situate upon the said lands and for ail other purposes and things necessary for or incidental to the exercise and enjoyment of the said rights. Provided however that ail right, title and interest acquired with respect to the aforesaid Parts 2,4 and 5 shall lapse and cease to be of any further force and effect upori the expiration of two years after the commencement of construction of the part of the said storm sewer system constructed on the respective parts immediately adjacent to each of the said Parts 2, 4 and 5. Any owher of lands in respect of which notice is given who desires an inquiry into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall notify the approving'authority in writing, (a) in the case of a registered owner, served personally or by registered mail within thirty days after he is served with the notice, or, when he is served by publication, within thirty days after the first publication of notice; (b) in the case of an owner who is not a registered owner, within thirty days after the first publication of the notice. NOTES: 1. The Expropriations Acf provides that, (a) where an inquiry is requested, if shall be conducted by an inquiry off icer appointed by the Minister of Justice and Attorney Generai; (b) the inquiry off icer, (i) shall give every party f0 the inquiry an opportunity f0 present evidence and argument and fo examine and cross-examine witnesses, either personally or by his counsel or agent, and (ii) may recommend f0 the approving authority that a party to the inquiry be paid a f ixed amount for his costs of the inquiry not f0 exceed $200 and the approving authority may in ifs discretion order the expropriating authority f0 pay such costs forthwith. 2. "owner" and "registered owner" are defined in the Act as follows: "owner" includes a mortgagee, tenant, execution creditor, a person entitled to a limited estate or interest in land, a committee of the estate of a mentally incompetent person or of a person incapable of managing his affairs, and a guardian, executor, administrator or trustee in whom land is vested; "registered owner" means an owner of land whose interest in the land is defined and whose name is specified in an instrument in the proper registry, land titles or sheriff's office, and includes a person shown as a tenant of land in the last revised assessment roll; 3. The expropriating authority, each owner who notifies the approving authority that he desires a hearIng in respect of the lands intended Io be expropriated and any owner added as a party by the inquiry officer are parties to the inquiry. WHITBY FREE PRESS, WEDNESDAY, MAY 9,1979, PAGE 11 Appreciation expressed to Volunteens Student volunteers from Henry Street High School and Denis O'Connor High Schools in Whitby and Eastdale Collegiate in Oshawa were given an ap- preciation'afternoon by the Whitby Psychiatric Hospital Friday. Members of Volunteer Services thanked the stu- dents for their participation in the hospital's Volunteen program, during two school terms; September to December and January to May. Twenty students per term participated from Henry Street High School, 15 and 18 per term from Eastdale Collegiate and two students from Denis O'Connor. The students from Henry High spent one hour per week over a period of eight weeks, helping at the hospi- tal and the Eastdale students spent two hours per week. The students from Henry, as part of their Grade 12 Physical Education course, spent Friday afternoons in the medical geriatric unit, assisting in games, crafts, cards and sing-alongs for the patients. They also worked with a physiotherapist, walk- ing patients on other units. The Eastdale students worked'in all the active and rehabilitative units in pairs during the evenings. The two girls from Denis O'Connor worked on the York active unit as part of their religion course, and took part in setting up a patient bowling.-tournament. It was announced at the appreciation afternoon that three volunteens will be stay- ing on as hospital volunteers, now that their present term of duty is over. This is the second year of the Volunteen program at the hospital, and the hospital staff said it was very suc- cessful, with more than 55 students taking part. Chamber meeting May 14 Jack Woodward, a past- president of the Whitby Chamber of Commerce, will address the May meeting of the Chamber on the subject of Traffic Distribution and Warehousing. The meeting will be held May 14 at noon in the cafe- teria at the Whitby Psychia- tric Hospital. Cancer Society happily announces that it has a new Education Chairman in the person of Mrs. Diane Harness of 337 St Lawrence St. The April Campaign Month is a particularly ap- propriate time for. this an- nouncement as 14 cents of every dollar raised at this time is spent on public edu- cation. Education of the public regarding the prevention of cancer was the prime reason for the formation of the Cancer Society back in 1938 at the request of the Cana- dian Medical Association. The natural followup to this, then, was the Society's subsequent involvement in the field of research so that today 55. cents of the same dollar goes toward this. The education program falls into three section-youth, adult, and industrial. Mrs. Harness will be primarily involved with youth educa- tion and will be providing materials dealing with can- cer and its prevention to schools and youth groups. Mrs. Harness, accompa- nied by Mrs. Marion Irwin,. Campaign Co-Chairman, attended an education meet- ing in Peterborough on Sat., April 21. for the purpose of learning about the Cancer Society's new education pro- gram for Grades 7 & 8. It is referred to as simply The Kit, and says Mrs. Har- ness "has some really in- teresting things for students of this age group to do and think about." Mrs. Harness is most an- xious to have a presentation meeting for The Kit so that teachers and other potential users may be more readily enticed to incorporate it into their programs.
