One child was born without fingers on his right hand, and another child has diag- nosed language delays. "In Guatemala, there's no security for our kids," Daniel said in an affidavit. "It's a difficult situation. I ask that the Canadian gov- ernment look at my chil- dren in deciding on this case." The family is still hold- ing out hope that MP Bar- dish Chagger or someone with influence at the feder- al level can help before it's too late. An email inquiry to Chagger's office wasn't im- mediately returned; how- ever, the family's previous application for permanent residency status in Canada based on humanitarian and compassionate grounds was denied be- cause the family didn't meet the requirements of refugees needing protec- tion. After residing in the De- troit area for years, the family entered Canada at the Fort Erie border cross- ing in April of 2017, and made a refugee claim. Under the Canada-U.S. Safe Third Country Agree- ment (STCA), most refugee claimants are unable to seek asylum at an official port of entry along the Can- ada-U.S. border, Gomez noted; however, the Roble- ro-Morales family was ex- empted from that ban be- cause they have relatives who reside legally in Cana- da. The rules of the STCA meant, however, that they were unable to appeal the decision ultimately made on their claim. The family, which has now been in Canada for more than two years, had been given a deportation order for July 12, but they didn't show up at the air- port. Warrants for their re- moval were issued a few weeks later. According to Gomez, things came to a head on Oct. 15 when Daniel was driving his children to school and they were stopped by Waterloo Re- gional Police in a routine traffic stop, then turned over to Canadian border of- ficials. The entire family was detained, though the chil- dren were released to fami- ly within hours. Gimder, who had turned 18 only two weeks before, was detained for 48 hours. Daniel was detained until his deportation. The family says they have faced a number of hur- dles thus far, including de- lays in putting forward their immigration applica- tion and lack of legal aid due to cuts by the Ford gov- ernment. The family is residing with Daniel's brother, who lives here legally, and the children have been attend- ing school since they ar- rived in Canada and have adjusted well to life here, their mom claims. "We ask those who read this to help us by reaching out to the Canadian gov- ernment, because we came here to seek refuge," she said. "We don't want to be separated or removed from this country. We came to work and contribute to Ca- nadian society. We came here for our family.
