The amendment to the City of Waterloo's cemetery servic- es bylaw came to council Aug. 28, after the public opposed a previous amendment that drastically curbed picture taking. The first amendment, passed in July, required any- one who wished to take pho- tos or videos within the cem- etery to first get permission from the manager. "Through citizens, we heard they'd like to take pho- tos without permission," said Mayor Dave Jaworsky. "We've reversed the bylaw, reversed the onus so, instead of being on every single citizen, it's on us (the city)." Instances where a ceme- tery manager could determine a person is not maintaining decorum, privacy or sanctity of the cemetery is if they're taking selfies at grave sites or taking live video for Facebook, Jaworsky said. The manager can then refuse or stop the person from continuing. "If a selfie phenomenon comes to our cemeteries, managers can take action if they want," Jaworsky said. According to a staff report, the new amendment, com- pared to the first amendment, communicates more clearly on why preventing photogra- phy and videography could be necessary. It also allows man- agers to provide better cus- tomer service by permitting family and friends take photos and videos, while also assur- ing them gravesites won't be disrespected. A bylaw is necessary because police have little juris- diction when it comes to deco- rum in cemeteries, unless it's happening after sundown and considered trespassing. "The bylaw in place adds an extra level of engagement from the municipality," said Bryce Crouse, the city's cem- etery manager. "It allows us to act quicker and helps us regu- late sites." But with staff confirming there have been no issues relating to photography and videography in city cemeter- ies, council was divided on if such restrictions should be included in the bylaw at all. "My concern here is there have never been any prob- lems," said Coun. Melissa Durrell. "This (amendment) sounds too strict to me, frank- ly." Coun. Mark Whaley called the bylaw amendments, "a big summertime waste of time. "There has been no terrible behaviour out there, we need to move on." Coun. Brian Bourke agreed putting any regulations on photography was "far too restrictive. "I'm not comfortable with the language here," he said. "Who gets to decide what decorum is? We need to let the public decide." In the end a 4-3 vote passed the amendment, with Jaworsky, Coun. Jeff Henry, Coun. Diane Freeman and Coun. Angela Vieth in favour.
