However if Meats Galore lost the rulâ€" ing and sued the city, the city would pay out any damages as an insurance claim and city taxpayers would be protected. Stockie confirmed Beausoleil‘s interpretation last week, saying he "anticipated" the city‘s insurance company would pay for any damages if Meats Galore successfully sued the city "I beheve that ethically the city should defend their own bylaw, whether there‘s a monetary involvement or not," he said Beausoleil said the city had sent him two letters of compliance to allow him to set up his business at the Lexington Road site long before the business actually opened in September, 1994. He also said he didn‘t see the city‘s action as a particular victory for himself or M&M Meats. "It‘s not a question of winning or los ing, it‘s a question of the city upholding the bylaws which they are supposed to enforce in the city," he said. "They do in most cases. And there shouldn‘t be any exceptions." However Beausoleil said he felt betrayed by the city‘s actions. "Do we live in a society where small business has to fight to defend the city‘s bylaws?" he said, when asked what he thought about the city‘s decision to withdraw from the case "I think M&Ms (Fred Doucette Holdings) has a problem with the city‘s bylaw," Beausoleil said. "And it‘s the city that‘s leaving us to defend monetarily M&Ms challenging their bylaw " "That‘s my opinion," he said. "But I haven‘t been told that offiâ€" cially by anyone." Doucette said he felt the city took the action it did because it came to realize it would have a weak case in court.
