The two solicitors e.-“ ducted a lengthy argument which | was very lively at times. The uhlt-‘ rators also participated in the arguâ€" ; ment, the bone of contention being whether.the arbitrators had the powâ€" er to make an appointment to proceed in view of the conflicting op-‘ inions of the Court of Appeal, in which Justice Garrow held that Bet-‘ tin shoutd first have passed a by-hwi designating the purpose for which the land on the Genz (farm was to be used, which Chief Justice Moss, Jusâ€" | tice Teetzel and Justice McLennan r held was unnecessary. Peterson v. the Berlin Acreage Comâ€" pany. s e This was an action brought by Lesâ€" lie Peterson, of Woolwich Township, against the Berlin Acreage Company for the balznce due him on an account between them. The plaintifl had been employed by the defendants as foreâ€" man in the year 1902, and had a large numper of men under him engagâ€" ed in lifting sugar bects. The action came on for trial before the Chancellor at the nonâ€"jury sittings at Berlin in June, 1903, and was by him referred to the Local Master. Afâ€" torâ€"a lengthy investigation before the master at Berlin, and in which the evidence was somewhat conflicting, the master found a balance in favor of the defendants, apart from the question of profits, of $125.00. The plaintiff then appealed from the findâ€" 1 1 Do o3 4â€" The plaintifi‘s appeal was allowcd and the question of profits and costs reserved.
