CHARGED WITH DEFAMATORY LIBEL Thore was a heavy docket at the Police Court Tuesday. Aiter the first case was disposed of Edwurd Waish, who was charged with deâ€" famatory libel by the C.P.R., received bis irollmlnnry trial as a result of which he was committed by the l:::nu for trial at the Fall A k Mr Schierholtz, of the Elmira Adve‘~ tiser, was the tirst witnoss callod. Ho recognized the prisoner who gave bis name as Edward Walsh. The cirouler mdneed was printed in his offiice at tigation of the prisoner. The prieâ€" oner dictated the copy of the circular. He had lost the copy. The circulars were delivered to the prisoner personâ€" ally. I saw some of the circulars lying on the roadside after the printing. of them. The prisoner was three times in my office. Prisoner said he had no questions to ask. Mr Werner upon oath deposed as follows: I am agent for the C.P.R. at Elmira. I saw prisoner first about the 16th of August at my office. I had some conversation with him and asked him for a sample of the circulars he was distributing. I asked him if ho wanted any assistance in the distribu tion of these circulars: He gave me a bunch and I gave them to detective Mnll(:{ of the C.P.R. Isaw nothing of Walsh after Friday until this mornâ€" ing. Walsh asked me if I was the local C.P.R. agent. Walsh said ho heard from Mr Zilliax that I was lookâ€" ing for him but hoged he had not otâ€" fended me. I told him I was afraid that his action would get him iuto trouble. Walsh said when be heard of the Protof accident bis heart bled for the injured ones. Walsh said ho was not afraid to inform the head officials of the C.P.R. about some afâ€" fairs. Walsh asked me for an envelope on Saturday, he put a circular in it and addressed it to Mr Shaughnessey. ~ DETECTIVE MULLO: . F. F. Mulloy, C.P.Ji detective, sworp, said:â€"My head oiuice is at Monâ€" treal. I was ordered to look up the author of the circulars in question. I met Mr Worner, be gave me this bunch of cireulars. I took proceedings to accomplish the arrest of prisoner. The gmoner was arrested by constable raser, of New Hamburg. Edward Walsch Committed For Trial. â€"John Schoudt Gets Six Mosths in Gaol For Abusing His Wife. Mr Alex Fraser sworn, said: I am a constable of the county of Waterloo. I arrested the prisoner. I told him I had no warrant but was instructed to effect the arrest from the chief at Waterloo. ‘The prisoner had no evi dences of the circulars when arrested. ‘The prisoner said he guessed he knew why ho was arrested, it was for issuing the circular about the C.P.R. Magistrate Weir then asked the prisoner if he wished to make any stateâ€" ment as to the charge. ‘The prisoner said the lssue of these circulars was in eonsequence of a conversation about the recent accident on the C. P. R. The man said that _ most of the pe(:&l: that travelled by C.P.R. did read the papers and did not know the danger they were in. He thought if the getting out of a few bills would save life he would do it. ‘The prisoner was committed for trial but was released upon his own recogâ€" mizance of bail for $500, to appear at the 8th of October assizes. ‘The first case to come up was that of John Schmidt, charged by his wife, Bophia Schmidt, with aggravated aesault on Sunday 24th inst.
