He refers to By-Law No. 185 passed in 1967 by Town Council which we quote in part: - "NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN- SHIP OF TERRACE BAY ENACTS AS FOLLOWS: I. Before approving of a plan of sub-division, Council shall enter into an agreement with the owner of the land respest- ing the services thereof; 2. When the land proposed for sub-division is in an area ; where municipal services, in the opinion of council, are ' economically available, the agreement with the subdivider | whall contain particular servicing and development require-- | ments based on the following general policy: (a) The owner or developer shall install and bear the full cost of all services required by the municipality, such as roads, ditches, storm sewers, water mains, sanitary sew- ers, sidewalks and street lighting, in o manner satisfactory to the Township engineer. (b) The owner shall be responsible, at his own expense, for the preparation of the necessary plans and submit such plens for the approval of the Township engineer. (c) No building permit shall be released by the building inspector unless sanitary sewers and water mains are avail- able to the particular lots or parcels concerned. (d) The Township will not assume ownership and mainten- ance of any work unless it has been installed in a manner approved by the Township engineer and is in a satisfactory condition at the end of the maintenance period set for each service in each case in the individual agreement.".
