[main page] An Abstract of Title (bold: 4 words) of Lot number______________ on the "(sticker: 1559)" side of ___________ street, in the <b> Town of Paris </b>, county of Brant and Province of Ontario, which said lot is supposed to be composed of a part of the <b> "Gore North of Dundas Stret." </b> The Town of Paris (bold: 3 words) became incorporated May 19th, 1855, 18th Victoria, chapter 148, and the boundaries, a therein described, embrace a part of lots 29, 30 and 31 in the 1st Concession of the TOWNSHIP OF SOUTH DUMFRIES, a part of lots No. 12 and 13 in the 1st Concession of the TOWNSHIP OF BRANTFORD, and a part of the "GORE NORTH OF DUNDAS STREET," lying between the two above named Townships, all of which are delineated on the annexed map. The Town being thus formed our of parts of six different Township lots, occasions great difficulty. First, to ascertain to what TOWNSHIP lot any Town lot may have belonged previous to its becoming associated with the Town limits; and, secondly, the position of hte title of such Township lot. It certainly forms no part of a Registrar's duties to plot out maps of the properties of which he gives abstracts, and, if it was, it could not be done from the data furnished him by the descriptions in the documents he records, inasmuch as boundaries are often made of "stumps," "trees," "stones," "creeks," &c., &c. Then again, it is generally assumed that each lot contains the EACT QUANTITY of land named in the patent whereas in fact almost every lot FALLS SHORT OF OVER RUNS a goodly number of acres. The Registrar, in order to aid those requiring to know the title of any such lot, has prepared the annexed map and printed sheets with great care, and believes them to be strictly correct, yet declines to assume any official responsibilities in connection with them beyond such portions as purport to be extracts from the records in his Office. THE GORE NORTH OF DUNDAS STREET. This is a narrow strip of land lying between the Townships of Brantford and South Dumfries, and being 15 chains 60 inks wide at its Eastern, and 22 chains 25 links wide at its Western extremity. The Eastern half has been measured out into Lots numbered - from East to West, from 1 to 20, and the West half, which runs through the Town of Paris has been sold by the Government in irregular parcels of various sizes, and some portions have been sold in connection with parcels of both of the said Townships, the whole being embraced in one descriptions by metes and bounds (italics: 21 words) For many years records were made in both (italics) Townships (Dumfries and Brantford) of lands lying in this gore. By the 2nd of Geo. IV., chapter 3, section 10, it is enacted, that the said Gore shall be attached to the Township of Dumfries. [first column] Patent granted by the crown to Hiram Capron. Bearing date Fe. 18th, 1836. Containing 2002 acres. Described as parts of lands in the gore of Indian Lands, North of Dundas Street, that is to say: Commencing first at the water's edge of the Grand River in the East side thereof, on the Southern limit of the 1st Concession of said Township of Dumfries; thence North 78 degrees East along the Southern limit of the 1st Concession of the said township of Dumfries, 54 chains 88 links, more or less, to where a post has been planted at the limit between the said parcel or tract of land and the lands of William Curtis; then South 11 degrees 40, East 22 chains 22 links, more or less, to where a post ahs been planted on the North side of Dundas Street, and on the limit between the said tract or parcel of land and of the said tract or parcel of land and the lands of the said William Curtis; then South 78 degrees, West 23 chains 33 links, more or less, along the North side of said Dundas Street, to where a post has been planted at an angle of hte said street; then Souht 79 degrees, West 12 chains, more or less, along the North side of Dundas Street aforesaid to the water's edge of the Grand River, where a post has been planted; thence along the Grand River against the Stream to the place of beginning. (According to the Registrar's plotting -unofficial- (italics) the above described parcel covers that part of the Gore within the Town of Paris, lying East of the River.) Also commencing where a post has been planted on the West side of the Grand River, on the North side of Dundas Street; then South 79 degrees, West 50 chains, more or less, along the North side of Dundas Street, to where a post has been plnated opposite the North-East angle of Lot No. 10 in the 1st Concession of the Township of Brantford, on the south side of Dundas street; then South 78 degrees, West 2 chains 90 links, more or less, to where a post has been planted at the South-East angle of the lands of Thomas Gadd; then North 15 degrees 49, West 24 chains 50 links, more or less, to where a post has been planted in the original line in front of the 1st Concession of the Township of Dumfries, and at the North-East angle of the lands of the said Thomas Gadd; then North 78 degrees, East 28 chains 30 links, more or less, along the original line in front of the said 1st Concession of the said Township of Dumfries, to an elm tree standing on the point in the forks to the Grand River, to the place of beginning containing 100 acres, more or less. Reserving the plaster bed at the forks of the Grand River, and the privilege of erecting machinery for the sole purpose of grinding or pulverizing the plaster. (According to the Registrar’s plotting -unofficial- (italics) the above described parcel that part of the Gore within the Town of Paris lying West of the Grand River.) There are a large number of entries described indefinitely as a part of the "Gore North of Dundas Street," and a still larger number of entries described by metes and bounds only, which are entered by the Registrar under the head "Miscellaneous." The only entries made by or to Hiram Capron, Christopher Holme, William Holme, Thomas Clark or Samuel Street, entered under either of the above headings, [second column] down to the date of incorporating the Town of Paris (may 19th, 1855) are the following: -According to the Registrar's plotting (unofficial) none of the many other entries described as aforesaid affect that part of the Gore of Dundas Street lying within the limits of the Town of Paris. Consideration, £250 0s. 0d. 2 parcels of 100 acres each. Described as in the above Patent, with immaterial exceptions. No. 91. Liber H. Assignment of Lease. (bold: 4 words) Bearing date July 20th, 1829. Registered Jan 23rd, 1833. From Christopher Holme. "Have agreed to assign over unto William Holme, &c., &c , all and singular other the premises in and by a certain written Indenture of Lease demised or mentioned, or intended so to be, with their and every of their appurtenances, made 1st of May, A.D. 1825, between Thomas Walker, of Falmouth, England, by his Attorney, James Wickens, and the said Christopher Holme." Registered an. 23rd, 1833. From William Holme to Hiram Capron have assigned all the singular other the premises in and by a certain written Indenture made May 1st, 1825, between Thomas Walker, by his Attorney James Wickens, and Christopher Holme, and afterwards to wit, on the 20th July, 1829, assigned and set over unto the said William Holme by the said Christopher Holme, his heirs, &c. Containing 100 acres. Described as in No. 91. No. 95. Liber H. Indenture of Lease. (bold: 4 words) Bearing date March 22nd, 1932. Registered Jan. 23rd, 1833. From William Holme to Hiram Capron. "As demised, leased and to farm let unto the said Hiram Capron, his heirs and assigns," &c , &c. Containing 100 acres. Described as the 1st parcel in the above Patent, with the exception of the Westerly limit running in the middle instead of on the Easterly margin of the Grand River. No. 138. Liber M. Deed Poll. "Whereby James Hamilton did renounce and disclaim all the real and personal estate, trusts, powers and authority whatever in and by the Will of the Hon. Thomas Clarke, deceased, written, demised, assigned and set over to him the said James Hamilton, jointly with Samuel Street and Robert Grant, and all the trusteeship thereof, and all rights, powers and authorities thereunto belonging or in anywise relating."
