Whereas one Thomas Curry made and [rented] to and in favour of me Miles O'Reilly of the City of Hamilton Esquire a certain mortgage on lot number seven in the south [illegible] of the Township of Burford including that part of the said lot written conveyed or intended so to be, dated on or about the fourth day of July 1840 for securing certain [illegible] [them] mentioned and interest there on; and whereas afterwards that is today on or about the twentieth day of January 1845 the writer named Charles Pickle made and [rented] another mortgage to and in favour of me the said Miles O'Reilly on the said lot for securing certain monies therein mentioned and interest thereon. Now know all whom it may concern that at the request of the said Charles Pickle I the said Miles O'Reilly do hereby promise the writer named Peter P. Falkins not to take any [illegible] to claim or take that part of the said lot written conveyed, under and by virtue of the said mortgages or [either] of then but to look solely to the other parts of the said lot and to the said Charles Pickle his heirs [executors] or administrators for recovering of the monies and interest remaining unpaid on the said mortgages or either of them provided always that these presents do not in anywise discharge [nethresuch] ("of") the other pacts of the said lot nor the said Charles Pickle his heirs executors or administrators from the payment of the said monies not from any proceedings at law or in equity for recovering the same as [illegible] my hand and seal this twenty fourth day of February 1855, Signed sealed and Delivered in presence of [C H Saners] [L.
