This Indenture, TRIPARTITE made the Second, --- day of ("February") March, one thousand eight hundred and Fifty Five in pursuance of the Act to facilitate the conveyance of real property, Between Charles Pickle of the Township of Norwich in the County of Oxford a Lumber Merchant of the First Part: Marietta M. Pickle of the same place, Wife of the said party of the First Part of the Second Part and Peter P. [Faulkins] of the Township of Brantford in the County of Brant [Yeoman] of the Third Part: Witnesseth, that in consideration of the sum of Thirty Seven Pounds and ten shillings of lawful Money of Canada, now paid by the said party of the Third Part, to the said party of the First Part, (the receipt whereof is hereby by him acknowledged,) He the said party of the First Part, does hereby grant unto the said Party of the Third Part, his heirs and assigns forever, ALL and singular, a certain parcel or tract of land of the Province of Canada, and situate on the Southerly part the north half of Lot number Seven in the Seventh Concession of the said Township of Brantford and may be getter known and described as follows, that is to say; commencing at the North East corner of Two acres of land sold to Francis Hamner, and on the Eastern [illegible] of the aforesaid lot, Thence South Seventy Eight degrees Thirty minutes West Ten chains, Thence south Fifteen degrees forty minutes East two chains, Thence south seventy eight degrees thirty minutes West Ten chains Thence North Fifteen degrees forty minutes West six chains and seventy links Thence north seventy eight degrees Thirty minutes East twenty chains to the allowance for road between Lots Number six and seven Thence South Fifteen degrees forty minutes East four chains and seventy links to the place of beginning To have and to to hold unto the said party of the Third Part, his heirs and assigns, to and for his and their sole and only use forever. Subject Never- theless to the reservations, limitations, provisos and conditions, expressed in the original grant thereof from the Crown. The said party of the First Part covenants with the said party of the Third Part, that his has the right to convey the said lands to the said party of the Third Part, notwithstanding any act of the said party of the First Part. And that the said party of the Third Part shall have quiet possession of the said lands, free from all [incumbrances]. And that the said party of the First Part will execute such further [assur- ances] of the said lands as may be requisite. And that he will produce the title deeds enumerated hereunder, and allow copies to be made of them, at the expense of the said party of the Third Part. And that the said party of the First Part has done no act to incumber the said lands. And the said party of the First Part releases to the said party of the Third Part, all his claims upon the said lands. And the said party of the Second Part, Wife of the said party of the First Part, hereby bars her Power in the said lands. In Witness whereof, the said parties hereto have hereunto set their Hands and Seals the day and year first above written.
