Wednesday March 29, 2000 THE OAKVILLE BEAVER A7 COMMENT O u r s y s te m The phrase "com m on decency" seems to be bandied about in legal cir cles these days. In fact, as much as there seems to be an increasing lack of common decency between people in everyday life, in legal circles it is all the rage. Take the recent nonsense about the Paul Bernardo appeal. Nearly five years after he was jailed for life in the murders of Kristen French and Leslie Mahaffy, the case is back before the courts again, in two cities. Lawyers Paul Bernstein and Tony Bryant, representing Bernardo, based their appeal on whether the jury was given enough information about Karla Hom olka. Their argum ents hinged on whether or not evidence about Bernardo's former wife was improperly led by the Crown suggest ing Homolka suffered from battered woman syndrome. They also contended the trial judge erred in not giving the jury more infor mation - that they couldn't convict Bernardo until they were absolutely certain Homolka did not kill the girls. C o m m o n VOLVO OF OAKVILLE w o rk IMPACT-ABSORBING 3.9% LEASE/FINANCE RATE gling with the possibility that despite the strength of the case against Bernardo, the Ontario Court of Appeal could order a new trial. "I don't know how I would deal with it," Mrs. French was quoted as saying. "I don't even want to think about it." No kidding. She has said that she has to brace herself for whatever comes next. She should not have to do this. When are we going to say: enough? No appeals for a convicted killer; no more dragging the courts through a costly exercise of futility. And no more putting the poor families through more than what any mother or father ever should ever have to go through. And although the Ontario Court of Appeal took only 15 minutes on Monday to reject Paul Bernardo's bid for a new trial, his lawyers could still go to the Supreme Court of Canada for a final appeal. Shut the door on this case. Enough is enough. n e e d s D IA N E H A R T $4 9 9 - * 5 9 9 TM . 2000 V o lv o S 7 0 S E 36 m onths $4760 down paym ent 20,000 kilom etres p/year Purchase at end of lease: $20,481.60 victed killer launch an appeal in the first place? And just why are we allowing what is clearly a simple obstruction of jus tice to spill into the always contentious - and costly - legal world of when evi dence must be turned over to the Crown? It all may be endlessly fascinating to the legal crowd, but it must be ago nizing for the families. Surely, with a case like this one, common decency would have us do more than simply shake our heads at a justice system gone awry. Surely we should just say: enough is enough.
