Accused teen claimed to be armed, jury told A 15-year-old Oakville teen claimed he had a knife seconds before he pushed another teen to the ground, jurors heard today. The Milton court was told that the first youth, whom many Crown witnesses say was drunk and angry, never produced the weapon. He only shoved and pushed Drew Hildebrand during their brief tussle around 11 p.m. on March 29, 2008. "(The teen) said he had a knife in his pocket, but said he didn't have to use it," a teenaged witness told the court. "He kept gesturing that he had it." "There were no punches thrown ... At one point he jumped at Drew and they fell," the teen said. Hildebrand, 16, hit the back of his head on the driveway of an Oakville home where a birthday party was being held. He died 10 days later in a Toronto hospital. Halton Crown prosecutor John Dibski argues the younger boy committed manslaughter because of the deadly aggravated assault. The boy's identity is protected by Canada's youth criminal laws. He has pleaded not guilty to manslaughter in this continuing trial before Justice John Murray. The teen testifying said Hildebrand didn't want to fight the accused. "He told everybody he didn't want to fight because of his facial piercings," the teen said. But the boy kept challenging him, the witness said. Jurors heard the two teens had two brief confrontations, the first starting soon after everybody began leaving the party. "They were grabbing each other by the shirts. They fell over a hedge," the teen said. They got up, but the accused kept walking back and forth, he said. "He was yelling... Others were yelling at him, telling him to go home," the witness said. Hildebrand and the accused moved to the bottom of the driveway, where the second confrontation occurred, jurors heard. Hildebrand went home after friends pulled the younger boy away from him. He complained of a headache and went to hospital the next day. He underwent surgery for a fractured skull and bleeding on his brain. The Oakville high school student then lapsed into a coma. He died without regaining consciousness.
