OAKVILLE BEAVER Wednesday, March 11, 2009 · 4 Crown witness testifies youth appeared to be ill Continued from page 1 This changed during the walk to the party when Hildebrand remarked that it was past the defendant's bedtime, according to the Crown. This upset the defendant, Dibski said. One of the Crown's first witnesses, the teen who hosted the party, testified that all four youths arrived at the party together. Pictures taken that night were displayed for the jury showing teens socializing, drinking, playing guitar, dancing and posing for the camera. In one picture, Hildebrand can be seen socializing with a number of teens in the host's bedroom. In another picture, the defendant can be seen in the same room. It was in this bedroom that Hildebrand and the defendant had their first confrontation, testified another Crown witness. In her introduction to the jury, this witness, who cannot be named as she was 17 at the time of the incident, noted that while she had two glasses of white wine and a beer during the evening she was not intoxicated when the confrontation in the bedroom took place. The witness described the defendant as drunk at the time, noting he was slurring his words and leaning on a hamper in the bedroom. "(The defendant) came in and accused Drew of having disrespected him earlier that night," testified the witness. "He said Drew had called him a baby. He gave Drew a shove in the chest. (Another girl) and I stood up and said we were going to have (the defendant) thrown out of the party if he touched Drew again." The witness said she was also outside for the final confrontation in which Hildebrand was injured. She testified the defendant stated he wanted to fight Hildebrand, but was being held back by another partygoer. At one point, the witness said, the defendant was actually retreating from the area until a friend goaded him into returning. At this point, the witness said, the defendant jumped on Hildebrand, knocking him to the ground where the back of his head hit the driveway. The fight was quickly broken up with the defendant leaving the area. Hildebrand also left the area and returned home. The witness testified she also eventually went to the Hildebrand residence, where she spent the night on a couch. She told the court that in the morning, she went into the upstairs bathroom where she noticed blood in the sink. Back in the living room, she saw Hildebrand lying on the couch. She said his shirt was off and he was wrapped in a blanket, clutching a bottle of water to his head. Hildebrand's mother was also in the room and told the witness to be quiet when she became aware of her presence. "I took that as a hint that Drew was sick," said the witness. "He looked pale." The defence will be presenting its case in the coming days with the trial itself expected to last between three to four weeks. FREE When Only o!
