A bitter battle culminated in the OMB hearing earlier this year -- itself as contentious as the rest. On May 18, the OMB released its decision -- one that allowed for Palm Place to build 300 units, but not the 370 it had hoped, and ordered half the property be turned over to the public as a park -- though that half is still contaminated and will require clean up. However, the decision also left the door open for further negotiation -- suggesting the town should take the time to look at acquisition by various means, including expropriation. A three-month delay in making the decision final was attached -- calling for both sides to take action within the three months or see the entire decision dismissed. McGinn called it a "split decision" and said there was an opportunity to purchase or expropriate the property -- an opportunity she said didn't previously exist. McGinn told council that if the Town didn't pursue the opportunity provided by the OMB it may as well have thrown out all the money it has spent so far in staff time and legal fees. While McGinn admitted she had no idea what the cost involved may be, she told council, "If you need money from the community, see me. I will help you as much as I can." Ward 1 Councillor Ralph Robinson said, "If anybody thinks the Bronte Quadrangle issue is tough and difficult, it's not any more tough and difficult than this one. Neither one are over, though this is probably closer." He then put forward the motion to look into acquiring the property. The HOV Study examined the implementation of HOV Lanes through the Town of Oakville, in Halton Region. In October 2000, MTO completed a Class Environmental Assessment Study (Class EA) for the widening of the QEW from east of Burloak Drive to west of Third Line (WP 169-00-00). In November 2005, MTO completed a Class EA Study for the widening of the QEW from east of Third Line to 1 km east of Trafalgar Road (WP 189-00-00). Both of these studies recommended widening the QEW by one lane in each direction. These recommendations were documented in Transportation Environmental Study Reports (TESRs) that were filed and received environmental clearance. The current HOV Study recommends utilizing the approved additional lanes, identified in the TESRs, to HOV Lanes. Proposed changes to the original recommendations are documented in TESR Addendum Reports. A TESR Addendum Report has been completed for each project and are now available for public review. THE PROCESS The HOV Study for the QEW between Burloak Drive and Third Line, and between Third Line and Trafalgar Road, have followed the approved planning process for a Group `B' under the Class Environmental Assessment for Provincial Transportation Facilities (2000) (Class EA).
