It is extremely helpful to study the warranty that usually arrives in the homeowner‘s hands after warranty program‘s receipt of the Certificate of Completion and Possession. Consumers often put all the onus on the warranty program to educate them when in fact they can gain the knowledge and prevent future disappointments for themselves. By taking the time to find out what parts of their home are covered by warranty and the length of time for that coverage, homeowners are able to be more proactive in the complete maintenance of their new home. An active involvement in the warranty means long term happiness. Small problems can be corrected before they become larger annoyances. Serious building defects can be recognized and rectified. While the warranty program was established in 1976 as a consumer protection watch dog, it attempts to balance the homeowner‘s rights with the builder‘s needs. The warranty program is not able to help homeowners who file a claim after the warranty coverage has expired. There is no such thing as a retroactive claim. Homeowners who wait until after the warranty has ended before filing their problem will find their coverage has expired. New homeowners should acquaint themselves with the facts concerning the various features being covered for the varying time periods. A homeowner with a complaint should notify the builder first in writing and send a copy to the warranty program, being mindful of the warranty time frame. Every now and again the warranty program encounters second owners who were not informed that the new home warranty is transferable from the first owners. Remember the warranty begins on the date of possession and remains with the home. If your home is enrolled after that date, then there is a seven year warranty against major structural defects.
