The new bylaw, replacing an existing one, would lower developâ€" ment charges and circumvent a potentially lengthy and costly Ontario Municipal Board (OMB) hearing threatened by developers. » 'fgz-‘. u\xs, $ )o "All appellants have agreed to withdraw their appeals, if council accepts these terms of settlement," said a regional finance report. "It is in everyone‘s favor to avoid a lengthy and costly hearing at the Ontario Municipal Board over the development charge appeals," the report said. Should there by a hearing, any development charge reductions ordered by the OMB would be retroactive and, according to finance commissioner Joe Rinaldo‘s report, "could involve a significant repayment of funds already collectâ€" ed by Halton." In February 1993, the region replaced its 1991 development charge bylaws with five new ones â€" one regionâ€"wide, others area speâ€" cific to cover Milton‘s 401 Industrial Park, Georgetown‘s new development, Georgetown‘s infill development and Oakville‘s Phase II lands. A month later, the bylaws were appealed by the Development Charges Coalition (DCC), an inforâ€" mal group of local builders and ADVERTISING FEATURE This weekly series highlights some of the best advertised values for food and household items offered by our featured grocery advertisers. Westman (Lumex) developers in Halton. On May 4, 1994,regional council approved in principle, terms of a negotiated settlement. Under the Development Charges Act, the region, has to hold two public information meetings before approving the settlement and its required new bylaw. The second public meeting was last Wednesday at the regional administration and finance commitâ€" tee meeting. The new bylaw will come before councillors at a special June 29 meeting prior to regional council voting on the bylaw the same day. Development charges, formerly lot levies, on residential and nonâ€" residential developments recover growthâ€"related servicing costs in new development and major redeâ€" velopment areas. The proposed appeal settlement would lower residential charges by 9.7 per cent from $5,212 to $4,706 on singleâ€"family detached units. It would drop proposed nonâ€"residenâ€" tial development charges by almost 30 per cent from $3.15 per sq. ft. of gross floor area to $2.28 That‘s still a 15 cent increase over the prevailing $2.13 per sq. nonâ€"residential charge, however, which was increased at the beginâ€" ning of this year from $1.20. Also included in the settlement are minor changes to Halton‘s inflaâ€" tion indexing and chargeable floor space definition for nonâ€"residential development charges, providing an exemption for indoor shopping mall common areas and retention of a + parking garage exemption. The proposed settlement terms affect only the regionâ€"wide bylaw, not the four area specific bylaws. "I see this as deal making," said Oakville Councillor Kevin Flynn. He called it a "shame" that such bartering dictates rates charged instead of logical, clinical reasons. Mr. Flynn said the staff report shouldn‘t read it "would not impose a financial burden on existing ratepayers" but "an additional burâ€" den." He looked to Oakville‘s examâ€" ple, saying new developments such as Glen Abbey were supposed to be "wonderful" for services in Oakville‘s established community. "It simply hasn‘t happened.
