THE CORPORATION < OF THE TOWNSHIP Det OF SCHREIBER D\ BY - LAW 2-91 eH Us te A By-Law to authorize the removal-of a structure contravening Section 5.2.2 Zoning By-Law No. 20-88 WHEREAS: a structure was constructed in 1990 in contravention of Section 5.2.2., of the Corporation of the Township of Schreiber Zoning By-Law No. 20- | 88, on the following described property: Lot 126, Plan M-120 Langworthy St. Township of Schreiber District of Thunder Bay NOW THEREFORE The Council of the Township of Schreiber, enacts as fol- lows; (1) This By-Law may be cited as the "Corporation of the Township of Schreiber (Removal By-Law 2-91)". (2) The Council is hereby authorized to carry out the removal of that structure located on the aforementioned property which is in violation of Section 5.2.2. of Zoning By-Law 2-88, by the servants or agents of the Council. (3) Thirty (80) days notice of the Council's intention to carry out the removal of the aforementioned structure shall be given to the owner of the land upon which the structure is constructed by return registered mail addressed to such owner at the owner's address as shown on the-last revised Assessment Roll, or at such more recent address as may be in the knowledge of Council. The owner shall also be given notice of the Owner's Right of Appeal-by sending to the owner a copy of Sections 138 to 141 of the Municipal Act. (4) Should the owner fail to remove the structure that was contructed contrary to. Section 5.2.2. of Zoning By-Law Number 20-88, within the said period of thir- ] ty (30) days, subject to any order that may be made by the Courts pursuant to Section 139 of the Municipal Act, the Coucil of the Township of Schreiber, may by its servants or agents, cause the removal of the structure that'was construct- ed contrary to the provisions of Section 5.2.2., of Zoning By-Law 20-88, at the owners expense. Should the owner fail to pay the costs of the removal of the offending structure on or before December 31st of the year in which the struc- ture is removed, then the expense thereofincurred by the Council,.with interest at a rate of 15% per annum, may be recovered by the Council in like manner as Township taxes. NOTICE OF PROMULGATION OF BY-LAW The above is a synopsis of a by-law passed by the Municipal Council of the Township of Schreiber, on the 26th day of February 1991. All persons are hereby required to take notice that anyone desirous of applying to have such by-law, or part thereof, quashed, must make his application for that purpose to the Supreme Court, within three months next, after the first pub- lication of this notice in the newspaper called the "Terrace Bay - Schreiber News", or he will be too late to be heard on that behalf.
