GREER This is the fifth and last article in a series dealing with the Canada Pension Plan. This arti- cle covers a fairly re- cent provision in the Canada Pension Plan Act, "The Division of Pension Credits". Upon the. termination of a marriage, through either divorce or legal annulment, pension credits earned by one or both spouses during their years of marriage, may be divided be- tween them. This provision is in- tended to ensure Cana- da Pension Plan pro- tection against the un- certainties of disability, death and retirement for a spouse working at home and any depend- ent children in the event of marriage dissolu- tion. To become eligible for this division of pension credits, the legal ter- mination of the marriage must have occurred af- ter January 1, 1978: Both spouses must have lived together for a mini- mum period of 36 con- secutive months during the marriage; the legal termination must be recognized by Canadian law; and the applica- tion must be submitted within 3 years of the marriage dissolution. As with all the bene- fits of the Canada Pen- sion Plan this pension credit sharing is not automatic upon the ter- mination of marriage. One of the parties in- volved must submit an application. At the time of the application, prop- er documentation must be supplied and includes both social insurance numbers, proof of age for both parties, proof of marriage and proof of divorce or legal annul- ment. Both parties will be notified of the results of the division of pension credits and will receive a statement reflecting earnings credited to them before and after the division. Both par- ties have the right to appeal any decisions made about the division of credits. "Our aim is to create 2,600 new rental apart- ments and all applica- tions will be considered on a first-come, _first- served basis. I believe many smaller munici- palities will welcome the opportunity to take part in the program," says Bennett. Launched initially in G PARTICIPALTIO! | Metro Toronto and Ot- tawa, the program was designed to be expand- ed to cover other areas with low rental vacan- cy rates. The Convert-to Rent program offers 15- year, interest-free loans of $7,000 per unit, to assist in the conversion of non-residential build- ings such as ware- houses, second-floor space above stores and vacant school property.
