Police Powers - Search and Seizure Enforcement The Law Reform Com- mission of Canada re- leased its Working Pa- per --- 30, entitled "Police Powers: Search and Seizure in Criminal. Law Enforcement". In that Working Paper, the Commission proposes that the powers of search and seizure con- ferred for the investiga- tion of offences against the Criminal Code and other federal statues, be subjected to a thorough- going consolidation, ra- tionalization and re- form. The Commission ad- vised that its recom- mendations for reform, had been guided by three central precepts. First, the disparate array of search and seiz- ure powers presently provided for criminal in- vestigations should be replaced by a single, comprehensive regime. Second, if search and seizure powers are meaningfully to comply with the Charter of Rights and Freedoms, the grounds for their ex- Sunnyside Private Hospital ordered closed! This hospital was originally licenced 26 years ago for 12 beds under the Private Hos- pitals Act. At approximately 1:00 p-m., on August 12th, 1983, the Ministry took control of Sunnyside Pri- vate Hospital under the authority of Section 7 of the recently passed Health Facilities Spe- cial Orders Act. Thirdly, the ex- ception to the rule that search shall be by war- rant should -be defined as to permit resort to powers of search with- out warrant only in cir- cumstances of recogniz- ed emergencies or in- formed consent. As a whole, the Com- mission's Working Pap- er is chiefly signifi- cant for its proposal that all police powers of search and seizure in criminal law enforce- ment be organized and governed within a single, comprehensive regime. If implemented, this proposal would eliminate the present increase of criminal search and seizure pow- ers. : Highlights of the Working Paper read: ***Consolidate, ra- tionalize and reform po- written consent must be obtained from those whose person, place or vehicle the police which to search without war- rant. ***Writs of assist- ance to be abolished. ***Provision to be made for 'Tele- warrant': search war- rants may be issued by telephone or other means of telecommuni- cation. ***Strip searches and probes of body cavities permissible only by war- rant; must be perform- ed by a qualified medi- cal practitioner and con- ducted in circumstances respectful of the pri- vacy of the person being examined. ***No surreptitious entry, search or seizure upon private premises; copy of search warrant must be presented to occupier before entry or as soon as practicable thereafter; in the case of unoccupied premises, a copy of the search war- rant must be left suit- ably affixed within the lice powers of search premises. and seizure within a ***The "information Single, comprehensive upon oath" which is regime. submitted by the police ***Search with war- rant to be the rule, and search without war- rant to be the excep- tion. ***Search without warrant permissible only where incidental to arrest or where the de- lay necessary to ob- tain a warrant would result in danger to-hu- man life or safety, or with consent. ***Consent search: a to obtain a search war- rant is to be accessible to everyone immedi- ately after the warrant has been executed. ***Prohibition again- st publishing or broad- casting contents of an 'information upon oath" or warrant until the prohibition is revok- ed by order of a superior court judge upon appli- cation by the person affected by the search or JUNIOR B- NORTHSTARS HOCKEY CLUB URGENT MESSAGE to all play- ers and anyone interested in working with the team either at an executive level or coaching or managing, please attend a meeting Sept. 8, Recreation Centre in Schreiber.
