Judge Rod Clarke in- terrupted the trial at this point and said that he was about to do some- thing that might be viewed as inappropriate but which he felt was necessary. Judge Clarke asked the Crown and the Defence to briefly re- view the evidence with him for a moment and specifically asked whe- ther or not the Crown had introduced any evi- dence showing that the defendant had been in- formed of his new Con- stitutional rights under section 10 of the Chart- er of Rights and Free- doms. These include, '*The right upon arrest to be informed promptly of the reasons; to be tried within a reason- able time; to be presum- ed innocent until pro- ven guilty; not to be denied bail without just cause; and the right to the assistance of an interpreter." The Crown conceded in fact no evidence had been introduced to show that the defendant had daughter BIRTH ANNOUNCEMENT IRWIN -- Carrie and James Irwin are pleased to announce the arrival of their KIRSTYN ANNE born June 18, 1983. Weighing in at 7 Ibs. 9% ozs. Pround grandparents are Mr. & Mrs. L. Waghorn and Mr. & Mrs. J. Irwin: been informed of his rights. The Crown then offered to recall the constable to the witness stand to clarify the point. However, the Crown had already pre- sented its evidence and closed its case, and Judge Clarke ruled that that would not be appro- priate. It was becoming in- creasingly obvious. that the Judge was serious- ly concerned about the Constitutional points, and might well decide the case on that basis alone without consider- ing the merits of the evi- dence that had been pre- sented. The Crown Attorn- ey attempted to fore- stall this by arguing that the Constitutional point, while it might be valid, should not stand in the way of a ruling in the case that was based on the evidence that had been presented from the witness stand. The de- fence seemed content to let the decision rest with . the judge and had little to say. After some consider- ation, Judge Rod Clarke ruled that the defendant was Not Guilty on Con- stitutional grounds. you.
