Description:
A handwritten lease agreement and indenture between William Duncan and Alfred Henson dated the 7th of January 1868 for a “dwelling house … more or less lying on the north side of the Hamilton road” as well as a barn and shed upon the same property for the sum of three dollars and fifty cents paid upon the seventh of each month and lasting one year.
Inscriptions:
This Indenture made the seventh day of January AD 1868 Between William Duncan of the [illegible] Brantford County of Brant Yeoman the first part and Alfred Henson of the [illegible] and County Butcher of the second part witnesseth that is consideration of the [rent?] convenants and agreements herein after revered and and Contained on the part of the said part of the second part – his executors administrators and assigns to be paid observed and performed he the said part of the first hath [demised?] and leased and by these [illegible] the [demise?] and lease unto the said part of the second part his heirs executors administers and assigns [all?] [illegible] message or [illegible] [Situate?] and lying being in the Village of Cainsville a dwelling House and [hay?] an [acer g?] and more or less lying on the north side of the Hamilton road bounded westerly by land owned by David [Shay?] Northerly by the farm of Joseph Thomas and easterly by a lot owned by Martin Deagel also that Barn and Shed on the south side of the Hamilton road [illegible] the House above described with a piece of land on the east side of the barn & shed about thirty – feet-wide To have and to hold the said [mortgage?] or [illegible] and premises unto the said part of the second part – his heirs executors and assigns for and during the [illegible] of One Year to be [Completed?] from the seventh day of January one thousand eight hundred and fifty eight – and from thenceforth Yielding and paying therefore monthly and every month during the said term hereby granted unto the said part of the first part his executors administrators and assigns the sum of three dollars fifty cents to be payable on the following days and times that is to say the first payment to become due and be made on the seventh day of February next and three dollars and fifty cents to be come due and be paid on the seventh day of each following

Month until the expiration of this agreement And the said part of the second part his heirs executors administrators or assigns do hereby covenant promise and agre to and with the said part of the first part his heirs executors administrators or assigns that the said part of the second part his executors administrators shall and will well and truly pay or cause to be paid to the said part of the first part his heirs executors administrators or assigns the said monthly rent reserved at the times and in the manner hereinbefore appointed for payment [thereof?]. and also [shale?] and [wile?] from time to time and at all times during the said term keep in good and sufficient repair the said premises hereby [demised?] reasonable wear and tear and accidents by fire and tempest excepted. And the [illegible] kept in repair shall and will at the end of expiration or the [illegible] determination of the said term peaceably and quietly yield and deliver up to the said part of the first part his heirs executors administrators or assigns. And also shall and will well and truly pay or cause to be paid all taxes, rates, [whatsoever?] whether Parlimentary local or otherwise which now are or which during the continuance of this demise shall at any time be rated. And the said part of the second part his executors administrators or assigns shall not nor will at any time or times during the continuance of this demise sell let or [illegible] or otherwise part with the [line illegible] demised or any part thereof to any person or persons for the whole or any part of the said term nor alter change or remove any part of the said premises yards or offices externally or internally without the license or consent in writing of the said
